i. No member of YFB will collect any personal data about you (that is, your name, address, telephone number, e-mail address or other data from which you can be identified) through the Site unless you provide it voluntarily.
ii. At the time of collection of any such Personal Data, YFB will seek your consent to various acts in relation to such Personal Data, e.g. using the Personal Data to contact you regarding seminars. A member of YFB may also subsequently contact you to seek your consent in relation to other proposed uses of the Personal Data, e.g. passing it to a third party for marketing purposes. Members of YFB will only use or process such Personal Data i) for the purpose for which it was originally submitted by you; or ii) for another purpose which you have expressly consented to.
iii. If you do not want your Personal Data collected, please do not submit it.
iv. Members of YFB will share Personal Data collected through the Site among themselves. In addition members of YFB may pass such Personal Data to any person providing IT services to a member of YFB. However, in such cases the relevant member of YFB will ensure that such provider of IT services only processes that Personal Data for and on behalf of members of YFB.
v. In some cases, YFB may collect information about you that
may not be Personal Data. Examples of this type of information
include the type of Internet browser you are using, the type of
computer operating system you are using, and the domain name of
the web site from which you linked to the Site.
vi. When you order or submit enquiries to Yoga for Baby you are agreeing to the use of your personal information for the following purposes:
- to fulfill our agreement with you, including administering any accounts, processing and obtaining payment
- to inform you (by mail, telephone, e-mail, or otherwise) about our products and services which we consider may be of interest to you
- for fraud prevention and detection
vii. When you view the Site some information may be stored on
your computer. This information will be in the form of a "cookie" or
similar file and will help YFB in many ways. For example,
cookies allow the Site or a related advertisement to be tailored
to better match your interests and preferences. You can erase
cookies from your computer hard drive, block all cookies or receive
a warning before a cookie is stored by configuring your Internet
Browser Software. Please refer to your Internet browser instructions
or help screen to learn more about these functions.
viii. Under UK Data Protection Law you have the right to see a copy of the personal
data held by a member of YFB about you.
ix. If you have submitted Personal Data through the Site and would either a)
like that information deleted from the records held by members of YFB, or b) if you require Personal Data which YFB holds about you to
be updated/corrected then please contact info@yogaforbaby.com. YFB
will use reasonable efforts to delete/correct this information from its existing
files and any party to whom it has passed such data.
x. YFB will not transfer Personal Data to any countries outside the European Economic Area without your prior consent and without first having assessed the adequacy of protection for individual rights in respect of personal data available in those countries.
xi. Please note that we will take reasonable and appropriate measures to ensure that Personal Data is stored in a secure manner. However, the Internet is inherently insecure and Personal Data submitted by means of the Internet may be vulnerable to unauthorised access by third parties. Submission of Personal Data using the Internet is at your own risk.
2. Indemnity
i. You hereby indemnify YFB, and each member of YFB , against all costs, expenses (including but not limited to reasonable legal costs and disbursements), losses and damages arising from or incurred by reason of any claims, demands, actions that arise as a result of your breach of these terms and conditions.
3. Jurisdiction
i. These terms and conditions shall be governed by and construed in accordance with the laws of Scotland. You hereby agree that in any contract formed hereby the place of performance will be Scotland. The Scottish courts shall determine any disputes relating to your access to and use of the Site.
ii. You are responsible for compliance with any applicable laws of the country from which you are accessing the Site.
4. Severability
If any court of competent jurisdiction finds any provision of these terms to be void or unenforceable for any reason, such provision shall be ineffective to the extent of the courts finding without affecting the validity and enforceability of any remaining provisions.
